1. General Provisions
- The online store MiataFamily.com (hereinafter: the “Store”) is operated by:

(privacy). - These Terms set out the rules for using the Store, placing orders, concluding and performing sales contracts for products, payments, deliveries, the right of withdrawal, the complaint procedure, and the principles of data processing to the extent necessary to perform the contract.
- The Store sells goods within the territory of the Republic of Poland and the European Union. Orders from outside the EU may require individual arrangements (customs, taxes, carrier) — in such cases the terms will be provided to the customer before the contract is concluded.
- Customers of the Store may be:
a) a Consumer (a natural person making a purchase not directly related to their business or professional activity),
b) a Privileged Entrepreneur (a natural person conducting business activity, making a purchase not of a professional nature for them),
c) an Entrepreneur (other business customers).
2. Definitions
- Account – a set of resources in the Store’s system assigned to a specific Customer, including data and order history.
- Business days – Monday to Friday excluding public holidays in Poland.
- Product/Goods – clothing and accessories offered in the Store.
- Order Form – an interactive form available in the Store enabling the placement of an Order.
- Contract – a distance sales contract concluded between the Customer and the Seller.
3. Account, technical requirements and rules of use
- Using the Store requires a device with Internet access, an up-to-date web browser and an active email address.
- Creating an Account is voluntary and free of charge. The Customer is obliged to provide truthful data and keep it up to date.
- It is prohibited to provide unlawful content, infringe third-party rights, disrupt the operation of the Store or attempt to circumvent security measures.
- The Seller may block an Account in the event of a flagrant violation of these Terms or of the law, after first calling on the Customer to cease infringements (where possible).
4. Product and price information
- Product prices are given in EUR (for the EU) and may be displayed in other currencies; prices include VAT and exclude delivery costs, which are shown separately during checkout.
- The Seller reserves the right to change prices and promotions; changes do not affect orders already placed.
- Product photos and descriptions are for presentation purposes; however, the Seller makes every effort to ensure they reflect reality (screen/calibration differences may cause slight colour deviations).
5. Placing orders and conclusion of the contract
- Orders are placed via the Order Form after adding products to the cart and accepting the Terms.
- Before placing an order, the Customer receives a summary: product description, price, total costs, method and time of delivery, payment method.
- The Contract is concluded when the Customer receives an email confirming acceptance of the order for processing (status: “Order accepted”).
- The Seller may refuse to process an order in justified cases (e.g., lack of timely payment, incorrect data, lack of availability) — promptly informing the Customer and refunding any amounts paid.
6. Payments
- Available payment methods:
a) online instant payments / BLIK / cards – via Tpay,
b) PayPal,
c) Visa / MasterCard card (also via Tpay/PayPal). - Payment should be made immediately after placing the order unless stated otherwise.
- The payment operator is, as applicable: Tpay, PayPal, Visa, MasterCard — under their respective terms.
7. Delivery
- Deliveries are made to the address indicated by the Customer within Poland and the EU.
- Available methods in Poland: InPost (parcel lockers/courier), Poczta Polska (courier/Pocztex). In the EU — carriers cooperating with logistics partners (e.g., international couriers).
- Estimated delivery times and costs are shown in the cart before the Contract is concluded. The delivery time is counted from the time the payment is credited and the order is completed.
- In the event of product unavailability, the Seller will promptly inform the Customer and propose: a refund, an exchange for another product, or partial fulfilment.
8. Right of withdrawal (returns)
- A Consumer and a Privileged Entrepreneur may withdraw from the Contract within 30 calendar days from the day they take possession of the goods (or the last item in the case of multi-parcel deliveries), without giving any reason.
- To effectively withdraw, it is sufficient to send a declaration by email to

- The Customer must return the goods to the returns address: MiataFamily.com, ul. Głuska 13b, 20-380 Lublin, Poland — no later than 14 days from submitting the declaration.
- Return shipping costs are borne by the Customer (unless agreed otherwise).
- The Seller refunds all payments received, including the cheapest standard delivery cost offered at purchase, within 14 days of receiving the withdrawal declaration, subject to the right to withhold the refund until receipt of the goods or proof of their dispatch.
- The Customer is liable for diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
- Exclusions from the right of withdrawal (including but not limited to): goods made to the Customer’s specification (personalised), goods in sealed packaging which, after opening, cannot be returned for health protection or hygiene reasons (e.g., underwear, socks) if the packaging was opened after delivery.

9. Complaints (lack of conformity of goods with the contract)
- The Seller is liable for lack of conformity of the goods with the contract existing at the time of delivery and revealed within the statutory period of liability.
- Liability period: as a rule 2 years from delivery (for used goods it may be 1 year — if applicable, this is indicated on the product page).
- Presumption: a lack of conformity revealed within 1 year of delivery is presumed to have existed at the time of delivery (unless this follows from the nature of the goods).
- Customer remedies: repair or replacement (as a rule, the Customer’s choice), and where these are impossible/excessively costly or not carried out within a reasonable time — price reduction or withdrawal from the contract.
- Submitting a complaint: email
(subject: “Complaint + order number”) including a description, requested remedy, and photos/video (if possible). - The Seller will respond to the complaint within 14 days; lack of response within this period means the request is deemed accepted (for a Consumer and a Privileged Entrepreneur).
- The costs of a justified complaint (including shipping) are borne by the Seller.
10. Size exchange (voluntary)
- Regardless of the right of withdrawal, the Customer may request a size exchange within 14 days of delivery.
- For the first exchange, the Seller may offer a return label on preferential terms; in other cases the shipping cost may be borne by the Customer.
11. Invoices and settlements
- Upon the Customer’s request, the Seller issues a VAT invoice (including an electronic invoice).
- The Customer agrees to receive accounting documents electronically at the email address provided.
12. Liability and intellectual property rights
- The Seller is not liable for the inability to place an order for reasons attributable to the Customer (technical issues on their side, incorrect data).
- This does not limit liability towards the Consumer arising from mandatory provisions of law.
- Photos, descriptions and the MiataFamily.com word/graphic mark are the property of the Seller or partners and are legally protected. Commercial use without consent is prohibited.
13. Personal data
- The rules for processing personal data are set out in the Privacy Policy available on the Store’s website.
- To the extent necessary to fulfil the order, Customer data is processed under Art. 6(1)(b) and (c) GDPR; for marketing purposes — on the basis of consent or legitimate interest, in accordance with the Privacy Policy.
14. Promotions, discount codes and special programmes
- Promotions and discount codes do not combine unless the specific promotion states otherwise.
- Detailed promotion terms are provided each time the promotion is announced.
15. Alternative dispute resolution and ODR
- A Consumer may use alternative dispute resolution (ADR), in particular before the competent Voivodeship Inspectorate of Trade Inspection.
- The EU ODR platform is available at: https://ec.europa.eu/consumers/odr.
- Matters not covered by ADR fall under the jurisdiction of common courts in accordance with the law.
16. Governing law and final provisions
- Contracts are governed by Polish law and the mandatory consumer protection provisions of the European Union.
- These Terms may be amended for important reasons (changes in law, offer, technology). We will inform customers 14 days in advance; contracts concluded before the change are governed by the previous version.
- The Terms are available free of charge on the Store’s website in a form that allows their acquisition, reproduction and recording.
- Matters not regulated herein are governed in particular by the Civil Code and consumer laws implementing EU directives (including 2011/83/EU).
